Terms of Service
1. General Provisions
1-1. Scope
These Terms of Service (hereinafter "these Terms") set forth the conditions for using the mobile application "Taplizm" and its related server functions and website (collectively, "the Service") provided by the Developer.
1-2. Acceptance
Users accept these Terms by giving consent on the consent screen displayed upon first launch of the app. In environments where no consent screen is shown (e.g., browsing the website), users are deemed to have accepted these Terms by using the Service. If you do not agree to these Terms, please do not use the Service.
1-3. Definitions
The following terms used in these Terms have the meanings set forth below.
- "The Service": The Taplizm mobile applications (iOS and Android), server functions, and related website
- "User": Any person who uses the Service
- "The Developer": The individual who develops, provides, and operates the Service
- "Device": A smartphone, tablet, or other equipment on which the Service is installed or used
- "Content": Software, design, text, images, audio, effects, and other data included in the Service
1-4. Relationship with Other Policies
In addition to these Terms, the Privacy Policy and any other guidelines separately established by the Developer form part of these Terms. In the event of a conflict between these Terms and any individual guideline, these Terms shall prevail. However, the Privacy Policy shall prevail with respect to privacy-related matters. Furthermore, where an individual guideline explicitly states that it takes precedence over these Terms, the provisions of that guideline shall prevail.
2. Service Description
2-1. Overview
The Service is an application that lets users tap rhythms on the screen and share them in real time with other users. It primarily provides the following features:
- Field Mode: Share rhythms with other users based on fixed coordinates set by the user
- Session Mode: Share rhythms in small-group rooms
- Feedback: Rhythm playback through vibration, audio, and visual effects
2-2. No Account Required
The Service can be used without account registration.
Connections are managed by a randomly generated identifier (device_id) assigned per device.
2-3. Usage Environment
Using the Service requires a compatible OS and device as well as an internet connection. Users bear all costs for purchasing devices, data communication, and other usage environment requirements.
3. Terms of Use
3-1. Eligibility
The Service is available to anyone who agrees to these Terms. However, use by minors is subject to Section 11. Use by persons outside Japan is subject to Section 14.
3-2. Device Management
Users are responsible for managing the devices on which the Service is installed. Users bear responsibility for any damage arising from inadequate device management or use by third parties.
4. Fees
4-1. Free Service
The Service provides its core features free of charge.
4-2. Paid Services
The Developer may in the future offer certain features or additional functionality of the Service for a fee. Pricing, payment methods, service conditions, refund methods, and related terms for paid services will be specified separately when they become available.
5. Advertising
The Developer may display advertisements within the Service and earn advertising revenue. The display method, content, and frequency of advertisements are determined at the Developer's discretion. If advertisements are introduced in the app in the future, the Developer will provide the required notices or obtain consent in accordance with applicable laws and Store policies.
6. Prohibited Activities
Users must not engage in any of the following activities when using the Service.
1. Activities that violate laws or public order
- Activities that violate the laws of the user's country of residence or of Japan
- Providing benefits to or otherwise cooperating with anti-social forces
- Aiding, abetting, or otherwise facilitating any of the above, or any similar activities
2. Activities that may interfere with the normal operation of the Service
- Placing excessive load on the Service's servers or networks
- Probing, scanning, or testing the Service for vulnerabilities (unless prior consent has been obtained from the Developer)
- Unauthorized access or attempts thereof
- Impersonating or unlawfully obtaining another user's
device_id - Using the Service to infringe on the privacy or rights of third parties
- Accessing the Service through modified programs, automated scripts, bots, or other tools not provided by the Developer
- Deliberately performing operations prohibited by the Service's usage guide while knowing they are prohibited
- Misusing the Service's features or servers to generate excessive traffic or load against others on the Internet
- Reverse engineering, decompiling, disassembling, or otherwise analyzing the source code of the Service's software for the purpose of any of the above (except to the extent explicitly permitted by law)
3. Activities that may interfere with the operation of the Service
- Sending viruses through the contact form or other communication channels
- Repeatedly sending identical, incomprehensible, or unrelated inquiries in large volumes through the contact form or other communication channels
- Sending unreasonable demands beyond a reasonable scope (such as demanding in-person apologies or kowtowing), sexual or discriminatory remarks, threats, or defamatory statements through the contact form or other communication channels
- Any other activities that may interfere with service operations
4. Other
Any other activities that the Developer reasonably deems inappropriate
7. Intellectual Property
7-1. Ownership
Copyrights, trademark rights, and other intellectual property rights in the software, design, text, images, audio, effects, and other Content included in the Service belong to the Developer or the rightful rights holders.
7-2. License
The Developer grants Users a non-exclusive, non-transferable, non-sublicensable, and revocable limited license to use the Service for personal and non-commercial purposes in accordance with these Terms.
7-3. Permission Regarding Screenshots
Users may create, save, and publicly transmit screenshots of the app. However, this does not apply in the following cases:
- When used for the purpose of harming the reputation of the Service or the Developer
- When used in a way that could mislead people into believing the Service is closely associated with unrelated companies, organizations, or individuals
If a screenshot contains intellectual property belonging to a party other than the Developer, the User is responsible for determining whether public transmission of that intellectual property is permitted. For reference, the Earth imagery in the app is a work of NASA and is not the Developer's work.
7-4. Restrictions
The license in the preceding section does not constitute a transfer of intellectual property rights in the Service. Users may not use, reproduce, modify, or distribute the Content of the Service beyond the scope expressly permitted by law or these Terms, unless the Developer has given prior written consent.
8. Privacy
The handling of information in the Service is governed by the Privacy Policy separately established by the Developer. Users should review the Privacy Policy before using the Service.
9. Disclaimers and Warranty Exclusions
9-1. As Is
The Service is provided "as is." The Developer makes no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, availability, security, or non-infringement.
9-2. Service Quality
The Developer does not guarantee that the Service will operate without interruption, errors, or security issues. Real-time synchronization accuracy, response speed, and other quality aspects of the Service may vary depending on network conditions, server status, device performance, and other factors.
9-3. Third-Party Services
The Service utilizes platforms, networks, and server infrastructure operated by Apple, Google, and other third parties. Failures, interruptions, changes, or termination of these third-party services may occur.
10. Limitation of Liability
10-1. Free Service
With respect to the Service provided free of charge, the Developer shall not be liable for any damage incurred by Users. However, if damage is caused to a User due to the Developer's willful misconduct or gross negligence, the Developer shall be liable in accordance with the Japanese Consumer Contract Act.
10-2. Paid Services
Where the Developer is liable for damages in connection with paid services, the total amount of liability shall not exceed the total amount paid by the User for the relevant paid service during the 12-month period preceding the date on which the damage occurred. However, if damage is caused to a User due to the Developer's willful misconduct or gross negligence, the Developer shall be liable in accordance with the Japanese Consumer Contract Act.
10-3. Exclusion of Indirect Damages
The Developer shall not be liable for any lost profits, data loss, indirect, special, incidental, punitive, or consequential damages arising from the User's use of the Service. However, if damage is caused to a User due to the Developer's willful misconduct or gross negligence, the Developer shall be liable in accordance with the Japanese Consumer Contract Act.
11. Use by Minors
11-1. Consent of Legal Guardian
If a User is a minor, the User shall obtain the consent of a legal guardian before using the Service.
11-2. Responsibility of Legal Guardian
Legal guardians shall verify the legal appropriateness of the minor's use of the Service and provide appropriate supervision, including usage time management.
11-3. Inquiries
If a User is a minor, inquiries to the Developer regarding the Service shall be made by the legal guardian.
12. Changes, Interruption, and Termination of Service
12-1. Changes
The Developer may change the content, features, specifications, and design of the Service without prior notice.
12-2. Interruption
The Developer may interrupt all or part of the Service without prior notice in the following cases:
- Maintenance or inspection of servers, communication lines, or related equipment
- Natural disasters, power outages, communication failures, or other force majeure events
- Unauthorized access, attacks, or similar incidents affecting servers or networks
- Failures, changes, or termination of third-party services used by the Service
- Other cases where the Developer reasonably determines that interruption is necessary
12-3. Termination
The Developer may terminate all or part of the Service for any reason. In the event of termination, the Developer will provide advance notice to the extent reasonably possible.
12-4. App Updates
The Developer distributes app updates to continuously improve the Service. As updates may include bug fixes and security patches, Users should apply updates as soon as possible. Depending on the update, older versions of the app may become unusable, in which case updating is required to continue using the Service. Even on devices that could previously run older versions of the app, the Service may become unavailable if the update cannot be applied due to insufficient storage or other reasons.
12-5. Changes to Supported OS Versions
The Developer may change (raise) the minimum supported OS version for the Service. Such changes may make the Service unavailable on devices that were previously compatible.
13. Restriction and Suspension of Use
13-1. Grounds for Restriction or Suspension
The Developer may restrict or suspend a specific User's access without prior notice if the Developer determines that any of the following applies:
- The User has violated these Terms
- The User, even without violating these Terms, is placing a load on the system through excessive operations or similar activities
- The maximum number of Users allowed by the system is already reached and the User's access cannot be accommodated
- The Developer otherwise reasonably determines that restriction or suspension is necessary
13-2. Inquiries and Objections
The Developer will not notify Users regarding whether a restriction or suspension has been applied, its duration, or the reasons. However, this does not prevent the Developer from providing such notification at its discretion. Users may inquire about the application, duration, and reasons for any restriction or suspension, or raise objections, through the contact form. The Developer does not commit to responding to all such inquiries or objections. However, this does not apply to matters for which a response is required by law.
14. Use from Outside Japan
14-1. User Responsibility
When using the Service from outside Japan, Users shall verify the legality of using the Service in the applicable country or region at their own responsibility.
14-2. Compliance with Laws
Users shall comply with all laws applicable to them (including export control regulations) when using the Service.
14-3. Developer's Responsibility
The Developer makes no warranties regarding the availability, legality, or suitability of the Service outside Japan.
15. Exclusion of Anti-Social Forces
Users represent and warrant that they are not members of organized crime groups (boryokudan), organized crime group members, quasi-members, organized crime group-affiliated companies, corporate racketeers (sokaiya), or any other anti-social forces (hereinafter "anti-social forces"), and that they do not have any socially reprehensible relationship with anti-social forces. If the Developer reasonably determines that a User is in violation of this provision, the Developer may suspend the User's access without prior notice.
16. Force Majeure
Performance of obligations under these Terms may be delayed or become impossible due to natural disasters, war, riots, civil unrest, terrorism, epidemics, enactment or amendment of laws, government actions, interruption of power supply, communication line failures, or other force majeure events.
17. Changes to These Terms
17-1. Method of Changes
The Developer may change these Terms without obtaining the individual consent of Users in either of the following cases:
- The change is in the general interest of Users
- The change does not conflict with the purpose of the agreement and is reasonable in light of the necessity for the change, the appropriateness of the revised terms, and other relevant circumstances
17-2. Notice
When changing these Terms, the Developer will publicize the revised terms and the effective date by the effective date through in-app notifications, posting on the website, or other appropriate methods.
17-3. Use After Changes
Users who use the Service on or after the effective date of any changes are deemed to have agreed to the revised Terms. If you do not agree to the revised Terms, please discontinue use of the Service.
17-4. Version-Specific Terms
The Developer may create terms of service that apply only to Users of a specific version of the app. In such cases, a consent screen for the terms will be displayed upon the first launch of the applicable app version, which shall serve as notice of the terms change. If you do not agree to the terms, please discontinue use of the applicable app version.
18. Severability
If any provision of these Terms is held to be invalid or unenforceable by law, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be interpreted in a manner that is valid and enforceable and closest to the original intent.
19. No Waiver
The failure or delay by the Developer to exercise any right under these Terms shall not be deemed a waiver of such right.
20. Communication
20-1. From the Developer to Users
Communications from the Developer to Users will be made through in-app notifications, store update notes, posting on the website, or other methods deemed appropriate by the Developer.
20-2. From Users to the Developer
Inquiries regarding the Service shall be made through the contact form. This does not apply where specific inquiry methods are prescribed by law.
21. Governing Law and Jurisdiction
21-1. Governing Law
The interpretation and application of these Terms shall be governed by the laws of Japan.
21-2. Jurisdiction
Disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Japan. Among the courts of Japan, the Tokyo District Court shall be the court of agreed exclusive jurisdiction for the first instance. However, this does not apply where a consumer is entitled by law to file a suit in the court having jurisdiction over the consumer's place of residence.
22. Language
The authoritative text of these Terms is in Japanese. In the event of any discrepancy between the Japanese version and any translated version, the Japanese version shall prevail. Translated versions are provided for reference purposes only and are not legally binding.
